MUMBAI: Zaid Vilatra, 20, accused of being a drug supplier and financing traffic on Monday withdrew his petition from Bombay high court where had challenged extension of judicial custody. The withdrawal submitted by his lawyer Taraq Sayed was since the law point raised by him was covered in the bail hearing by five other co-accused before another bench of the HC.
Narcotics Control Bureau (NCB) had arrested Vilatra, a Bandra resident after searching his premises on September 1. He had challenged a September 9 order of the special NDPS court which sent him to Judicial custody. On September 11, the special Narcotic Drugs and Psychotropic Substances (NDPS) court rejected his bail plea along with those of actor Rhea Chakraborty and her brother, in the case being investigated by the NCB in connection with a “drug angle’’ in the June 14 death of actor Sushant Singh Rajput.
Sayed who challenged the invocation of a non-bailable section 27A (financing illicit traffic) on the grounds that it will not be applicable to small or non-commercial quantities had said, “there is absolutely no recovery of any contraband at his instance and there is absolutely no nexus between him and any contraband of commercial quantity.’’
The next day his “alleged voluntary statement” was recorded where he allegedly confessed that the Rs 9.5 lakh along with USD 200 and other foreign currencies were “sale proceeds of drugs.’’ He said he retracted the statement immediately on September 3.
Justice Sarang Kotwal who has reserved five bail pleas including that of siblings Rhea and Showik Chakraborty is likely to pronounce the decision later this week.
